Recent proposals for reform of the Ontario Rules of Civil Procedure have taken aim at ‘motions culture’, and particularly summary judgment motions. However, our quantitative analysis of summary judgment motions in Ontario in the past decade has shown that summary judgment motions have plummeted in number and have not recovered. Our article investigates this phenomenon and its probable causes, as well as implications for current reform efforts.
