In its much-acclaimed decision on climate change, the Federal Constitutional Court of Germany has developed the concept of an “intertemporal guarantee of freedom” that requires spreading the opportunities associated with freedom proportionately across generations. The presentation will explain, analyze, and criticize this construction, also with a view to its import on transnational climate change litigation more generally.
